Terms of Service

Welcome to MonstarX!

These Terms of Service ("Terms") govern your access to and use of the MonstarX platform, operated by Monstar Lab Pte Ltd, located at 9 Straits View, Marina One West Tower, #05-07, Singapore 018937 ("Monstarlab", "we", "us", or "our").

By using MonstarX (the "Service"), you agree to these Terms. Please read them carefully. If you do not agree, do not use the Service.

1. About MonstarX

MonstarX is an AI-powered platform that helps users create, prototype, and test digital products quickly — from idea to working proof of concept (PoC).

The Service may include features for generating content, designs, and code using AI technologies.

2. Eligibility

You must be at least 18 years old to use MonstarX.

By using the Service, you represent that you have the authority to enter into this agreement on your own behalf or on behalf of the company you represent.

If you're using MonstarX on behalf of an organization, these Terms apply to that organization, and you confirm that you are authorized to bind it to these Terms.

3. Account Registration and Security

To use MonstarX, you'll need to create an account — usually through Google Sign-In or another supported method.

You are responsible for:

• Keeping your login credentials secure.
• All activity that occurs under your account.
• Immediately notifying us at [email protected] if you suspect unauthorized use.

We may suspend or terminate accounts that appear compromised, inactive for extended periods, or in violation of these Terms.

4. Acceptable Use Policy

You agree not to use MonstarX to:

• Violate any laws or regulations.
• Upload, share, or generate harmful, illegal, or offensive content.
• Attempt to reverse engineer, copy, or disrupt the Service.
• Infringe on the rights of others, including intellectual property or privacy rights.
• Abuse or overload our systems through bots, automation, or malicious code.

We reserve the right to remove any content and suspend access if we reasonably believe it violates this policy.

5. Your Content and Ownership

You retain ownership of the content, data, code, or materials ("User Content") you create using MonstarX.

By submitting or generating content through the Service, you grant Monstarlab a limited, non-exclusive, worldwide license to store, process, and display it only as necessary to operate and improve the Service.

We do not claim ownership of your ideas, projects, or generated outputs.

Enterprise customers can request private model deployments where no data is shared outside their controlled environment.

6. AI-Generated Content

MonstarX uses AI models to help generate text, designs, or code.

You are responsible for reviewing and validating all AI-generated content before using or publishing it.

While we strive for high accuracy, the output may occasionally contain errors or inaccuracies.

You agree that Monstarlab is not liable for any damages, losses, or issues arising from reliance on AI-generated content.

7. Intellectual Property

All intellectual property in MonstarX — including software, design, branding, algorithms, and AI systems — belongs to Monstar Lab Pte Ltd or its licensors.

You may not:

• Copy, modify, or redistribute any part of the platform.
• Create derivative works based on MonstarX.
• Use our trademarks or branding without written consent.

We respect the intellectual property of others and expect you to do the same. If you believe your rights have been infringed, contact [email protected].

8. Plans, Payments, and Trials

Some features of MonstarX are free. Others require a paid subscription.

• Billing: Paid plans are billed in advance, either monthly or annually.
• Renewals: Subscriptions automatically renew unless cancelled before the next billing cycle.
• Refunds: Payments are non-refundable except as required by law.
• Trials: Free trials may be offered and can be changed or revoked at any time.

Enterprise customers will have separate terms outlined in their Master Service Agreement (MSA).

9. Termination

You may stop using MonstarX at any time by deleting your account.

We may suspend or terminate your access if:

• You violate these Terms.
• You misuse or attempt to disrupt the Service.
• We discontinue the Service (with reasonable notice).

Upon termination, your right to use MonstarX will cease immediately, but your ownership of your own content remains unaffected. We may retain necessary data as required by law or for legitimate business purposes.

10. Service Availability and Updates

We're continuously improving MonstarX.

This means we may add, modify, or remove features at any time, with or without notice.

We do our best to keep the platform online and secure, but we can't guarantee uninterrupted access.

We're not liable for any downtime, data loss, or service interruptions that occur despite reasonable safeguards.

11. Disclaimer of Warranties

MonstarX is provided "as is" and "as available" without warranties of any kind, express or implied.

We do not warrant that:

• The Service will be error-free or uninterrupted.
• AI-generated results will be accurate or fit for any particular purpose.
• All data transmissions will be completely secure.

You use the Service at your own discretion and risk.

12. Limitation of Liability

To the fullest extent permitted by law, Monstar Lab Pte Ltd and its affiliates shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages.
• Loss of profits, data, or goodwill arising from your use of the Service.

Our total aggregate liability under these Terms shall not exceed the greater of:

• The amount you paid for the Service in the past 12 months, or
• SGD 100.

Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability, so these may not apply to you.

13. Indemnification

You agree to indemnify and hold harmless Monstar Lab Pte Ltd, its directors, employees, and partners from any claims, damages, or expenses arising from your use of the Service, your content, or your violation of these Terms.

14. Privacy

Your use of MonstarX is also governed by our Privacy Policy, which explains how we collect and handle your personal data.

By using the Service, you agree to the practices described there.

15. Changes to These Terms

We may update these Terms periodically to reflect product changes, new laws, or business updates.

When we make material changes, we'll notify you by email or in-app notice before they take effect.

The latest version will always be available at https://monstarx.com/terms.

16. Governing Law and Dispute Resolution

These Terms are governed by the laws of Singapore, without regard to its conflict-of-law principles.

Any dispute or claim will be subject to the exclusive jurisdiction of the courts of Singapore.
